Opinion by JUDGE VAN CISE Merrill Ladell McBridge, the licensee, appeals the judgment of the district court affirming the revocation of his driver's license for three months by the Department of Revenue pursuant to the implied consent law, § 42-4-1202, C.R.S. 1973. We affirm. At a hearing before the Department, it was discovered that the arresting officer had not properly sworn to the affidavit which had been submitted to the Department concerning reasonable grounds to believe licensee had been driving while under the influence of alcohol and his refusal to submit to a chemical test. The licensee moved for dismissal. The hearing officer dismissed the action without prejudice.
